These Terms and Conditions (“Terms”) govern your access to and use of all services provided by Mega Fitness LLC, including but not limited to gym memberships, small group training, fitness classes, facilities, and any online or digital content (collectively, the “Services”).

1. Acceptance of Terms

By accessing or using any part of the Services, you agree to be bound by these Terms and any additional guidelines, rules, or policies posted on our website or at our facilities. If you do not agree to these Terms, you must discontinue use of the Services immediately.

2. Modifications to Terms

We reserve the right to change or modify any part of these Terms at any time without prior notice. Changes become effective immediately upon posting. Continued use of the Services after such changes constitutes acceptance of the modified Terms. Please review these Terms periodically.

3. Ownership and Operation

MegaFit Underground LLC is owned and operated by Javier Salgado. All Services, content, materials, logos, images, video, written text, and branding made available through the Services are the property of the Company or its licensors and are protected by United States and international copyright, trademark, and intellectual property laws.

4. Copyright and Intellectual Property

All materials and content provided by MegaFit Underground LLC—including but not limited to training materials, program designs, class content, videos, images, and logos—are copyrighted works and are the exclusive property of MegaFit Underground LLC or its authorized partners.

We may also terminate your use of the Services at any time at our sole discretion, without liability or prior notice.

6. Assumption of Risk & Waiver of Liability

By using our Services, you voluntarily assume the risks associated with physical activity and exercise. You agree to release and hold harmless MegaFit Underground LLC, its trainers, staff, contractors, and affiliates from any and all claims of liability for injuries, losses, or damages arising from participation in gym activities, including but not limited to small group training and fitness classes.

7. Membership Terms

• All memberships are month-to-month. There are no long-term contracts.

• You may cancel your membership with at least 5 business days’ notice before your next billing date.

• No refunds will be provided for partial months, missed classes, or early cancellations outside the permitted window.

8. Code of Conduct

All members must adhere to a standard of respectful and responsible behavior while using MegaFit facilities. We reserve the right to suspend or terminate access to the Services for any conduct deemed unsafe, disruptive, or inappropriate.

9. No Guarantees

MegaFit Underground LLC does not guarantee any specific fitness results, outcomes, or trainer availability. Trainers, class formats, schedules, and services are subject to change without notice.

10. Governing Law

These Terms and any disputes arising out of or related to the Services shall be governed by the laws of the State in which Mega Fitness operates, without regard to conflict of law provisions.
